General trading conditions for the online-shop of the company

hereafter referred to as "MaxxTech.se" -
§ 1 Product Selection
(1) The customer has the possibility of selecting and of ordering on the Website specified products.
(2) Regarding each product the customer receives a separate product description on the homepage.
(3) The customer can click the products wished by him on the Website. These are collected in a virtual order basket and at the end of his order the customer receives a compilation of the products, the total end price inclusive the legal value added tax.
(4) Before dispatching, MaxxTech.se enables the customer, to control the order for its contentwise correctness, in particular on price and quantity to examine and correct if necessary.
§ 2 Return Instruction : a) Return Right
The customer can return the received commodity without indication of reasons within two weeks by return of the commodity. The period begins at the earliest with receipt of the commodity. Only with commodity not package-capable of being shipped (e.g. at bulky goods) the customer can explain the return also by cancelling demands in text form, thus e.g. by letter, fax or E-Mail. For keeping the punctual sending off of the commodity or the cancelling demand meets the period. In each case the return takes place at expense and danger of the customer. § 2 Return Instruction : b) Return Sequences
In the case of an effective return are uses if necessary pulled (e.g. customs advantages) on both sides received achievements to be refunded. With a degradation of the commodity indemnification according to value can be required. This does not apply, if the degradation of the commodity exclusives on their examination - as it would have been possible for the customer for instance to lead back in the company´s shop. In all other respects the customer can avoid the indemnification according to value obligation, by taking the commodity not like an owner in use and omitting everything, which impairs their value.
The return right does not exist with contracts
a) for the supply of goods, which are made after special requests or clearly are cut to the personal needs or which are not suitable for a return due to their condition or fast to spoil to be able or their expiration date was exceeded,
b) for the supply of audio, video tapes and software, if the supplied data media were unsealed by the consumer,
c) for the supply of light bulbs, newspapers, magazines and pictorials or
d) for the contribution and lottery services.
§ 3 Unclaimed packages.
If MaxxTech.se deliver an order to a swedish customer as "postförskott" e.g. pay at pickup at the post office or the location to where the package has been sent and the customer fails to claim and pay for the package, MaxxTech.se will send an invoice to the customer of the total cost MaxxTech.se has had for this transaction plus a handling fee of SEK 400 excl swedish VAT (SEK 400 exkl. moms). If the customer does not pay the invoice it will be sent to the collector's office (Kronofogdemyndigheten) for collection.
§ 4 Revocation Instruction : a) Right of Revocation
The customer knows its contract explanation within two weeks without indication of reasons in text form (e.g. letter, fax, email) recall or by return of the item. The period begins at the earliest with receipt of this instruction. For keeping the punctual sending off of the revocation or the thing meets the period of revocation. The revocation is to arrange on: US Performance Parts AB, Box 304, SE-18424 Åkersberga
§ 4 Revocation Instruction : b) Revocation Sequences
To be given change in the case of an effective revocation on both sides received achievements to be refunded and uses if necessary pulled (e.g. interest) are. Items package-capable of being shipped are not fetched at the customer.
§ 4 Revocation Instruction : c) Special References
The right of revocation of the customer expires prematurely, if the contracting party of the customer began with the execution of the service with express agreement of the customer before end of the period of revocation or the customer arranged these (e.g. by Download etc.).
The right of revocation does not exist with contracts

§ 5 Prices
(1) The list prices apply at the time of the order, as they were represented on the websites.
(2) the prices understand themselves starting from operating seat of MaxxTech.se inclusive value added tax without costs of packing and dispatch.
§ 6 Contract Conclusion
(1) The offers on the Website of MaxxTech.se are not-binding. Thus MaxxTech.se is not obligated in the case of the unavailability to the achievement. A conclusion of a contract and thus a contractual connection over the individual achievements come off however then, if MaxxTech.se confirmed the order of the customer in text form.
(2) MaxxTech.se is justified to supply a commodity equivalent in quality and price if the ordered commodity is not available and the customer explained his agreement as this procedure in the purchase order form.
§ 7 Contract Execution : a) Treatment of orders
MaxxTech.se will work on and to the customer will communicate orders within 48 hours (on workdays) whether the desired products are available.

As far as the ordered products are available, MaxxTech.se will deliver these within 10 working-days after receipt of the order.

§ 7 Contract Execution : d) Changes, Extensions, Delimitations
MaxxTech will answer all inquiries of the customer in connection with orders already transacted concerning changes, extensions and/or delimitations of the product. As far as the customer up to 5 working-days before the planned supply wishes a change of product, an extension and/or a delimitation, MaxxTech.se will consider this as far as possible.
§ 8 Service Hotline
(1) MaxxTech.se issues the customer for the ordered commodity a calculation, which is handed out to him on supply of the commodity. MaxxTech.se supplies only against pre-payment. Pre-payments or orders for the deduction of credit cards are considered during the rendering of invoice.
(2) Prices on the calculation are always final customer prices inclusive value added tax.
(3) When payment is done by credit card, a proof can be required for the identity, in particular with orders from the foreign countries !
§ 9 Guarantee and Liability
(1) The customer will inform MaxxTech.se about any lack concerning the product and will additionally send back the product at expense of MaxxTech.se.
In the business course of business the guarantee is limited for MaxxTech.se to one year and is justified to repair the product after its choice or place free replacement.
(2) MaxxTech.se clings to
a) in full extent of the damage with rough being to blame for of its organs and leading employee,
b) after the reason with each culpable injury of substantial contract obligations,
c) outside of such obligations after the reason also for rough being to blame for of simple executing aides, it is, MaxxTech.se can for strength commercial custom of it free-draw,
d) of the height after in the last two drop's groups on substitution of the typical foreseeable damage. A contributory negligence of the customer is to be taken into account to this. The liability because of resolution, warranty, bad cunning and for personal injuries as well as after the product liability law remains unaffected of it !
§ 10 Higher Force
(1) If MaxxTech.se owed achievement due to higher force (in particular war, natural catastrophes) cannot furnish, it is released for the duration of preventing from their obligations to perform.
(2) If MaxxTech.se can´t execute the order and/or supply the commodity for more than one month due to higher force impossible, then the customer is entitled to allow the cancellation of the contract.
§ 11 Exports
The customer has the obligation to inform himself about the laws and customs regulations of his country before he places an order. MaxxTech.se supplies an invoice with the commodity, which contains an appropriate description of the article and the declared value. The customer is responsible alone for all damages, which result from offences against the laws and customs regulations of the receivers country !
§ 12 Privacy & Security
(1) MaxxTech.se values its customers and all technically feasible steps are taken to protect their privacy. We do not sell or rent personal information to third parties. In order to demonstrate our commitment to your privacy, we have prepared this statement disclosing the privacy practices for the entire site. Additional terms and conditions, if any, regarding the collection and use of your information may also be provided to you before you sign up for a particular service.
(2) In general, when you visit our website and access information, you remain anonymous. Personal information from visitors to our website is collected on a voluntary basis only and an explanation is provided as to its use at the time it is requested. This collected personal information is used to respond to online queries, supply requested information on MaxxTech.se products and services, enable online sales, ship ordered products, establish approved links, and for internal market analysis. § 14 Final Clauses
(1) Contract language is English.
(2) If any determination of these conditions should be futile or become, then the conditions remain in all other respects effective. MaxxTech.se and the customer will replace the futile regulation by such a effective, which comes the will of the contracting parties economically next.
(3) Area of jurisdiction for both parties is Österåkers Kommun, Sweden and all juridical matters will be decided by Swedish Court, Attunda Tingsrätt.
